Report of fraud at Bury FC investigated

A fraud investigation has been launched involving Bury Football Club, police have confirmed.

Greater Manchester Police said it had received a report of fraud but no arrests have been made.

The club was expelled from the Football League on 27 August after a late takeover bid from C&N Sporting Risk failed.

Bury is the first club to drop out of the Football League since Maidstone was liquidated in 1992.

Timeline: Bury's EFL demise

  • 30 July: EFL suspends club's first game of the season asks them to prove financial viability
  • 9 Aug: Bury are given until 23:59 on 23 August to provide "clarity required" as the third game is called off
  • 20 Aug: Sixth Shakers game suspended, while owner Steve Dale rejects offer to buy the club
  • 23 Aug: Bury granted extension until 17:00 on 27 August in light of bid from C&N Sporting Risk
  • 27 Aug: EFL expel Bury after C&N Sporting Risk withdraws the interest

Bury FC: EFL to 'consult with clubs' about efforts to readmit Shakers

The English Football League is to discuss Bury's future with its member clubs following efforts to reinstate the Shakers in League Two next season.

Bury were expelled from the EFL on 27 August after a failed takeover bid by C&N Sporting Risk.

Bury North MP James Frith has called for the Shakers to re-enter in the fourth tier for the 2020-21 season.

Bury: 'Rescue board' of expelled Shakers submits plans for future of the club to EFL

A working group set up to try to have Bury reinstated to League Two in the 2020-21 season has sent its proposal to the English Football League.

The submission from the Bury FC Rescue Board includes a signed statement from owner Steve Dale saying he is committed to selling the club.

The proposal, signed by Bury North MP James Frith, also contains confirmation of "active committed bidders".

Bury, who were in League One, were expelled from the EFL in August.

Meanwhile, the club faces another court date on 16 October for a winding-up petition brought by HM Revenue & Customs.

'A simple and common-sense solution'

Frith, chair of the board, said the plan is "a simple and common-sense solution for everyone involved".

In a statement from the rescue board, it urges "compassionate re-entry for our club" to League Two.

"We accept that the EFL has had to take action given the mismanagement that has brought Bury FC to this position. However, we believe the expulsion followed by the loss of a season's football and readmission on terms you dictate is a fair punishment," the statement continued.

Alongside Labour MP Frith, the proposal to the EFL has been backed by the Bury FC Supporters' Trust, Bury South MP Ivan Lewis and Mayor of Greater Manchester Andy Burnham.

Also included in the Greater Manchester Combined Authority and Bury Council, who have both offered "to work together to provide necessary external challenge and diligence to ensure any proposal is financially viable and can deliver stability for both the club and the league in the long term".

Bury's 125-year membership of the Football League was ended after a proposed takeover bid from potential owners C&N Sporting Risk collapsed.

The Shakers had already had their first five league games cancelled and been thrown out of the Carabao Cup for non-fulfilment of a first-round fixture.

Bury's expulsion means that three clubs, rather than four, will be relegated from League One this season and just one, instead of two, will go down from League Two.

Bury will not be readmitted into League Two next season after a meeting of member clubs

A proposal for Bury to be readmitted to League Two next season was rejected by the English Football League's 71 member clubs at a meeting on Thursday.

Bury, who were in League One, were expelled from the EFL in August after a last-ditch takeover bid collapsed.

On Friday, a group trying to rescue Bury submitted a plan for "compassionate re-entry" to League Two.

However, an EFL statement said, "it became clear that the proposal did not have the necessary support".

It added that EFL clubs' "preferred direction of travel" was "extending the existing principle of a reduction in relegation across all divisions as a means of returning to 72 clubs now and for the future".

It means only one team will go down from League Two this campaign, rather than two, while three clubs will go down from League One.

EFL executive chair Debbie Jevans said: "While we are saddened that Bury FC is no longer part of the EFL, the board's difficult decision to withdraw membership was only taken after every opportunity to find a resolution was exhausted.

"Since then, in recognition of the efforts made on behalf of the club, the EFL has engaged with supporters' groups, shared their submissions with our members and debated at length the issues raised.

"Following the discussion today, clubs have established that the preferred direction of travel is to reduce relegation from League Two as a means of returning to 72 clubs.

"The clubs felt that, in a difficult situation, this approach maintains fairness for all members and upholds the principle of the football pyramid."

Bury FC: HM Revenue & Customs winding-up petition adjourned for 14 days

Bury have been granted a 14-day extension after a winding-up petition brought by HM Revenue & Customs was adjourned in the High Court.

The club have been given the additional time to pay back smaller businesses, reports BBC Radio Manchester.

The Shakers were expelled from the English Football League in August as a result of their financial problems.

A prospective buyer for the club ended their interest on Monday, leaving Bury on the brink of liquidation.

A group of Bury supporters have already been working on plans to form a phoenix club and, if successful, would have to apply to the Football Association for entry into the English non-league pyramid next season.

FA Cup first round: Bury expulsion means bye to the second round for one team

One club will receive a bye to round two of the FA Cup when the first-round draw is made on Thursday, following Bury's removal from the competition.

The Shakers were expelled from the English Football League - and subsequently the cup - in August.

The 47 remaining League One and League Two clubs will join 32 non-league outfits in the first round in November.

The club that receives the bye will also be awarded the £36,000 prize money for a first-round winner.

The final club left in the pot during the draw will receive the bye.

Shame they didn't do the draw as if Bury were in it, livens it up a bit if you don't know when the team with the bye is coming.

Could have done an unlucky winner too, give one of the teams who fall in the Fourth Qualifying round another go. Happened when Man United didn't enter years ago I believe.

Bury's lawyers told the court a further extension was needed to establish whether the club paid too much tax.

The case was adjourned by Judge Nicholas Briggs until 4 December.

The Shakers had looked to be on the brink of liquidation after a prospective buyer for the club ended their interest earlier in October.

However, the club say they believe they have continued to automatically pay tax on wages that would otherwise have been paid to staff, despite those wages not being paid.

The judge therefore issued the adjournment to "determine whether HMRC have been overpaid".

Bury North MP James Frith previously met with the Football Association to discuss the possibility of the club rejoining the pyramid at National League level.

Meanwhile, a group of Bury supporters have also worked on plans to form a phoenix club and, if successful, would have to apply to the FA for entry into the English non-league pyramid next season.

A statement issued by the group on Wednesday said: "Whilst the fate of The Bury Football Club Ltd continues to officially hang in the balance, the work of the phoenix group and the volunteers involved will continue.

"The town of Bury needs and deserves a football club. It needs a football club that will never find itself in this position ever again.

"We will continue to sow the seeds for a rebirth for when the seemingly inevitable occurs. There will be a football team in Bury come August 2020 and our resolve to see this through remains as strong as ever. "

Bury: Winding-up petition over unpaid tax bill dismissed by High Court

A winding-up petition issued against Bury over an unpaid tax bill has been dismissed by the High Court.

The Shakers were expelled from the English Football League in August after failing to provide financial guarantees and the collapse of a takeover bid.

The club was previously given two weeks to allow the processing of tax returns to HM Revenue & Customs.

However, a lawyer for HMRC told the Insolvency and Companies Court that a debt had been paid.

Bury Football Club default on a plan to settle outstanding debts

Fresh doubt has been cast over the future of Bury Football Club after they defaulted on a plan to help settle their outstanding debts.

Creditors approved a company voluntary arrangement (CVA) proposal last July which would have seen the club's football creditors paid in full.

Unsecured creditors, including HMRC, were due to be paid 25% of the money owed.

Bury, who were expelled from the English Football League last August, had until Tuesday to pay the CVA.

Watched it last night. Honestly, was a bit disappointed with it to be honest. Obviously, the whole thing probably changed with the pandemic but though there would be a bit more in depth of how the new club was born and a bit more of the day to day stuff.
